The U.S. Supreme Court on Monday handed the Review-Journal another legal victory in its long-running dispute with the Las Vegas Sun, declining to take up the Sun’s petition asking justices to overturn a lower-court ruling that the companies’ joint operating agreement is “unenforceable.”
The high court’s refusal to hear the case upholds an August ruling from a three-judge panel of the 9th U.S. Circuit Court of Appeals. The panel said the newspapers’ 20-year-old arrangement, which requires the Review-Journal to carry the Sun as a separate section in its daily newspaper, was illegal because it was never signed by the U.S. attorney general as required by the federal Newspaper Preservation Act.
