Workplace Diversity, Equity & Inclusion 2026

The Conference Board recently published “Workplace Diversity, Equity & Inclusion 2026: A C-Suite Guide to the Legal Landscape,” which Olson co-authored with Allan Schweyer of TCB’s Human Capital Center. The piece maps the current multiagency enforcement environment in practical terms, covering the DOJ’s Civil Rights Fraud Initiative and its False Claims Act exposure for federal contractors, the EEOC’s restored quorum and its sharpened focus on intentional discrimination (including recent subpoena enforcement action against a major retailer), and the FTC’s January letters to 42 law firms signaling antitrust scrutiny of coordinated DEI benchmarking programs like Mansfield Certification.
